Let’s Funjoy Adventure Pvt. Ltd. – HOPUP Kids Play Area Participant Agreement Waiver, Release & Assumption of Risk

Fill out the form completely & submit it or print it & bring the copy to the park before your participation. Submit a copy of your or your parent’s/guardian’s (if you are under 18 years of age) photo identity proof (Aadhar Card/PAN Card/Driving Licence, etc.) with your online submission or bring the physical copy to HOPUP when you want to participate in the park’s activities.

Special instructions for Kids Play Area:

Kids from 2 to 10 years are allowed in HOPUP Kids Play Area. Parents are allowed but on a separate charge.

The risks include, among other things: HOPUP Kids Play Area entails certain risks that simply cannot be eliminated without jeopardizing the play area’s overall experience and essential qualities of its activities. Risks include the negligence of other participants or yourself, injuries including rope burns, sprains, fractures, scrapes, bruises and cuts, joint dislocations, pinched fingers, and serious injuries to the head, back, or neck which can cause paralysis, or even death. Kids Play Area exposes its participants to the usual risk of cuts and bruises. Other more serious risks exist as well. Participants often fall off of the equipment, sprain or break wrists, ankles, and legs, and can suffer more serious injuries as well. Traveling to and from Kids Play Area locations raises the possibility of any manner of transportation accidents. Participants often fall on each other resulting in broken bones and other serious injuries. In any event, if you or your child is injured, you or your child may require medical assistance, at your own expense. Furthermore, HOPUP employees have extremely difficult and high-risk jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s health issues or abilities. They may give incomplete warnings or instructions, and the equipment being used might malfunction in rare cases.

1. I acknowledge that my participation in any HOPUP Kids Play Area’s game or multiple activities entails obvious and often unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the play area’s overall experience and essential qualities of its activities.

2. I expressly agree and promise to accept and assume all of the risks existing in the Kids Play Area’s activities. My participation in this activity is purely voluntary, and I elect to participate in spite of all the risks I’m now aware of.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold HOPUP Kids Play Area harmless from any and all claims, demands, or causes of action, which are in any way connected with my participation in the park’s activities or my use of all its equipment or facilities including any such claims which alleged negligent acts or omissions of HOPUP Kids Play Area. 4. Should HOPUP Kids Play Area or anyone acting on their behalf be required to incur any sort of legal or attorney fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

In the event that I file a lawsuit against HOPUP Kids Play Area, I agree to do so solely in the state of Punjab, and I further agree that the substantive law of Punjab shall apply that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

By signing this document, I acknowledge that if anyone, including myself, is hurt or HOPUP’s property is damaged during my participation in the play area’s activities, I may be found by a court of law to have waived my right to maintain a lawsuit against HOPUP Kids Play Area on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. I further grant HOPUP Kids Play Area the right to photograph, videotape, and/or record me and/or my child/ward and to use my or my child’s/wards’ name, face, likeness, voice, and appearance in connection with exhibitions, publicity, social media marketing, advertising, and promotional materials without reservation or limitation. I would like to receive free email promotions and discounts to the email address provided above. I may unsubscribe to emails from HOPUP at any time. I do hereby declare that I have read and fully understood the contents of this Waiver Form along with the HOPUP Guidelines and that I have had the opportunity to discuss the same with my parent/guardian* and that I agree to be bound by the said terms and conditions of the above agreement with HOPUP Kids Play Area.

I Undertaker to Abide by all rules and regulations and in case of an accident any natural whatsoever, I agree to keep indemnified the entity, the management, their shareholders, servants, owners, partners, joint partners, consultants, agents, employees, contractors etc.

I hereby declared that I have not consumed nor intend to consume alcoholic beverages and/or drugs immediately before or during the driving session.

I hereby Undertaker to indemnify and keep indemnified all costs, expense and charges that the entity may incur rectified damage caused to the karts, equipment, track or third parties etc. arising out of my failure to follow instructions and guidelines or due to my negligence/misuse or dangerous driving.

I hereby declare I am over 18 years of age and shall be bound by the terms and conditions as started above.
